Transition period has ended after December 31st 2020. British nationals became Non-EU citizens and will be subject to all Spanish immigration rules like any other third-country national. This means that any privilege under EU freedom of movement will come to an end. So now, what is the process to be an Au Pair in Spain after the Brexit?
However, UK citizens who stablished their residence in other EU country before the end of the transition period, will maintain their free movements rights after December 31st 2020.
Up from January 1st 2021, British nationals traveling to Spain for holidays, business or to visit family do not require a visa for stays of up to 90 days in a 180-day period, provided the visit is not for a gainful activity. Please note the 90 days will start counting from the date they enter any of the Schengen countries, including Spain.
British citizens will need a visa for journey undertaken after 31st December 2020 for the purposes of residence, studies for period larger than 90 days, work, professional, artistic or religious activities.
Having said that, the visa process to be an au pair in Spain after the Brexit , is not specifically defined. We mean there is not a specific Au pair visa. Then it will be like in many other countries. Au pairs coming to Spain apply for a student visa and therefore will follow up from January 2021, will need to follow this process:
- If they want to be an au pair for stays up to 90 days (1 or 2 or 3 months), they do not require a student visa. They need to apply for a tourist Schengen visa .
- If they want to be an au pair for stays longer than 90 days (more than 3 months) they need to apply for a student visa. You can check All about the Au Pair / Student visa in Spain and costs involved.
There are 2 options to apply for a student visa in Spain:

2. They can apply for the student visa once in Spain, applying directly at the Spanish Immigration office (Oficina de Extranjería de España). This means they can enter as a tourist in Spain, and once in Spain, then apply for a student visa, it is not necessary to go back to home country. We can help you in Spain with this process.
